Ennis Gymnastics Club – Terms, Policies & Child Protection

These Terms, Policies, and Codes of Conduct (“Terms”) govern your use of Ennis Gymnastics Club’s website, services, classes, camps, events, and related products (collectively, “Services”). By registering, attending, or making payments for the Services, you agree to these Terms.

These Terms are governed by Irish law. Disputes fall under the exclusive jurisdiction of the Irish courts.

1. Membership & Registration

• Membership is open to gymnasts of all ages.
• Parents/guardians of children under 18 must register on behalf of their child.
• Accurate and up-to-date information (medical conditions, allergies, emergency contacts) must be provided.
• Failure to provide relevant information may limit the Club’s ability to ensure safety.

2. Fees, Payments & Billing

• Fees must be paid in advance.
• Monthly payments are due on the 22nd of each month for the following month. Late payments incur a €10 fee.
• AutoPay is recommended.
• Continuous enrollment guarantees your child’s spot if fees are up to date.
• Summer programs are optional; schedules may vary.

Late Collection Fees:

• 1st occurrence (15–60 min late): €5 per hour or part thereof
• Subsequent occurrences: €10 per hour or part thereof
• Children must wait inside the gym until collected.

3. Refund & Credit Policy

• No refunds for:
  • Absences due to illness, holidays, or personal reasons
  • Classes or programs already in progress
• Credits may be issued at the Club’s discretion in exceptional circumstances.
• If classes are cancelled by the Club, a credit note or make-up session will be offered.
• For COVID-19 or other closures, fees may be frozen or converted into credits for future use.
• Statutory consumer rights remain unaffected.

4. Withdrawal & Cancellation

• 2 weeks’ notice required for cancellations of classes or camps.
• Withdrawals must be submitted online via the Withdrawal Form.
• Late or verbal cancellations incur full charges for the next month’s tuition.

5. Health & Safety

• Gymnastics involves inherent risks; participation is at your own risk.
• Coaches may provide spotting or assistance.
• Parents/guardians are responsible for supervision before and after classes; the Club is not a childcare facility.
• Emergency medical treatment will be provided by qualified staff where necessary.

6. Codes of Conduct

6.1 Gymnasts

• Respect coaches and peers; follow instructions and use equipment safely.
• Wear suitable clothing and remove jewellery.
• Follow Club rules, hygiene, and safety protocols.
• Non-compliance may result in suspension or expulsion.

6.2 Parents/Guardians

• Wait in designated areas only; do not enter the gym floor.
• Drop-off and collection must be punctual.
• Support coaches’ instructions and foster a safe, positive environment.
• The Club is not responsible for unsupervised children outside class times.

6.3 Staff & Volunteers

• Complete safeguarding and Children First training.
• Respect children, parents, and colleagues.
• Report concerns immediately to the DLP.

7. Photography & Media Consent

• Parents/guardians must consent for photography/video recording.
• Consent is optional, specific, and revocable.
• Media may be used for promotion, newsletters, website, social media, and coaching purposes.
• Images/videos are stored securely for a reasonable retention period.

8. Data Protection

• Personal data is handled in compliance with GDPR.
• Data may be stored using third-party services (e.g., iClassPro, US-based), with appropriate safeguards.
• Parents/guardians may request access, correction, or deletion of personal data.

9. Liability & Indemnity

• Except for death or personal injury caused by negligence, the Club is not liable for:
  • Lost or stolen property
  • Indirect or consequential losses
• Parents/guardians agree to indemnify the Club against claims arising from breaches of rules, negligence, or inaccurate information.

10. Force Majeure

• The Club is not liable for delays or failures due to events beyond its control (pandemics, extreme weather, strikes, government restrictions).
• Services may be rescheduled or credits applied in such cases.

11. COVID-19 & Infectious Diseases

• Members must follow public health guidance.
• Attendance may be refused if symptoms are present or guidance is not followed.
• The Club may operate virtual sessions, adjust schedules, or freeze fees during restrictions.

12. Online Classes & Digital Content

• Recording or sharing online classes without consent is prohibited.
• Technical issues may affect access; the Club is not liable for interruptions.
• All digital content remains the property of Ennis Gymnastics Club.

13. Intellectual Property

• Website, materials, and branding are the property of Ennis Gymnastics Club.
• No reproduction, modification, or commercial use without written consent.

14. Communications

• By registering, you consent to essential communications regarding classes, events, and safety notices.
• Marketing communications require opt-in consent and can be withdrawn at any time.
